Our governance framework

Our Framework Document sets out our overarching structure for governance and accountability. This makes sure that we manage risks, protect personal data, and remain transparent about our goals, how we will achieve them and their outcomes.

Our Chief Executive is accountable to Scottish Ministers for the management of the agency and the services we provide. He is supported by an executive leadership team who are responsible for setting our strategic priorities, ensuring our delivery structures and performance collectively align to achieve our goals.

Our strategic direction and financial sustainability are supported by the Disclosure Scotland Advisory Board (the Board) and the Audit and Risk Committee (ARC). Meeting minutes, Board structures and registers of interest are publicly documented.

Disclosure (Scotland) Act 2020

This is a piece of primary legislation that further reformed state disclosure in Scotland. It simplifies disclosure products and makes PVG scheme membership a legal requirement for people working in a regulated role.

Protection of Vulnerable Groups (Scotland) Act 2007

This is the legislation underpinning the PVG scheme, which we administer. The scheme makes sure that individuals unsuitable to work with children and protected adults cannot carry out regulated roles.

Age of Criminal Responsibility (Scotland) Act 2019

This governs how pre-12 behaviour is handled in disclosure checks.
The Rehabilitation of Offenders Act 1974 also governs parts of the disclosure system.
